Child Support
If you are a parent seeking child support or wishing to modify an existing child support order we understand that these can be very complex and difficult issues. First, it is important to understand that a parent has a legal obligation in the state of California to support their children. The courts determine the level of support required by a mathematical calculation. The calculation uses some of the following attributes when making the child support award and order:
- Number of Children;
- Percentage of Time spent with children;
- Gross Income of the parents;
- Taxes paid;
- Pensions;
- Union Dues;
- Health Insurance; and
- Any other prior child Support orders.
It is inherent in this formula that either one of the parents or both of the parents feel that they are not receiving enough in child support or are paying too much. That is why it is vitally important to ensure that you have the right legal representation throughout the process.
Child Custody
Child custody matters can be the most difficult matters to resolve. Child custody issues generally require the determination of the legal and physical rights to minor children, which are generally under 18. Child custody orders and determination are based on the Best Interest of the Child or children. The court will look at several factors to make this determination. There are two types of child custody;
- Legal Custody; and
- Physical Custody.
A parent that has legal custody has the legal right to make the decisions of the child concerning schooling, medial care, and their basic upbringing. A parent that has physical custody has the legal right to have the child or children live with them. There are many various arrangements that can be made between spouses and their children.
